PAYMENT
A retainer in the amount of $500 is due and payable within 2 weeks of the contract for services is signed. This holds the date of your wedding exclusively, and is non-refundable. The balance is due no later than two weeks prior to the date of the wedding.

All payments are due as described unless prepaid. If the event is cancelled within three months of the date, the client shall pay the balance of the contract due to the high probability that Hey Sisters! Photography will be unable to rebook that date. 

Payments are to be made by check to Hey Sisters! Photography. You can mail your check to our corporate office, located at 5450 Miami St., South Bend, IN 46614. 

All travel fees, where applicable, must be paid on or prior to the second payment due date, which falls two weeks prior to the date of the wedding. Travel fees are FREE within a 25 mile radius of South Bend, IN. Thereafter, the travel fee for Hey Sisters! Photography is $0.50 per mile, both to and from the wedding and reception locations.

EXCLUSIVITY
Hey Sisters! Photography will be the exclusive professional photographer hired by the Clients for the purpose of photographing the wedding. Family and friends of the Clients are welcome to photograph the wedding as long as they will not interfere with Hey Sisters! Photography’s duties. 

Because a wedding is an uncontrolled event, Hey Sisters! Photography cannot guarantee delivery of any specifically requested image(s). However, we will do our best to provide requested images discussed prior to the wedding date.

In the unlikely event of personal illness or other circumstances beyond the control of Hey Sisters! Photography, Hey Sisters! Photography shall make reasonable efforts to substitute another competent professional to fulfill the obligations of this Agreement. 

COPYRIGHT & USAGE
A DVD or Flash Drive with high resolution digital images will be sent to the bride and groom within 90 days of the wedding date.

Clients will have the limited right to make and use copies of the digital images provided, for their own use in email and on personal web pages. Clients will not make copies for sale or for the purpose of circumventing the sale of images by Hey Sisters! Photography, nor will the client authorize any reproductions of the images for commercial use or for photographic competition or display.

Hey Sisters! Photography will furnish the client with a written release, which will allow the Client to make copies, prints and other reproductions for personal, non-commercial use and distribution.

Hey Sisters! Photography retains copyright of all images created and will have the right to make reproductions for portfolio samples, self-promotion, and professional competition.
NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce photographs or videos elsewhere without Hey Sisters! Photography’s permission. Violators of this Federal Law will be subject to its civil and criminal penalties.

Liability: If Photographer or her agent is unable to perform any or all of the duties herein for any reason, including but not limited to, fire, transportation problems, acts of God, accident, illness, or technical problems, and if she cannot provide another competent professional, all money received by Photographer, will be returned to Client, and Photographer shall have no further liability with respect to this agreement. This limitation of liability also applies to any loss/damage of photographs or failure to deliver photographs for any reason. Liability for a partial loss of photographs shall be pro-rated based on the percentage of total. The sole remedy for any actions or claims shall be limited to a refund whose total amount cannot exceed the total monies paid by Client under this Agreement during the time preceding the date on which such liability arises.

FINAL PHOTO PRODUCT
The Client is hiring Hey Sisters! Photography for their technical and artistic expertise and, therefore, reserves the right to edit the images as they see fit.  

The client understands that the quantity of photographs taken at the event can vary greatly and that photography by nature is an art, subject to the creativity of the photographer and her personal artistic style. The client understands that he/she has chosen the photographer because of her photographic style, and will grant the photographer the right to exercise her creativity in the interest of creating the best images possible. The client understands he/she may not demand a refund, or a redo due to differences in artistic preferences of the final images.

Post-production costs: Requests for changes to the final Images will be subject to an editing surcharge of $150.00 per hour.  

WEDDING DAY ITINERARY & FAMILY PORTRAITS: 
Client agrees to submit a wedding day itinerary draft and formal family portrait list no later than 4 weeks prior to the wedding date. Photographer will review the timeline and may suggest adjustments to ensure adequate time is provided for photography services. Photographer will provide examples of timelines and a formal family portrait list to Client for reference. Notification of any changes in schedule or location must be made in a timely manner. Changes may be made via email for documentation purposes.

BREAKS/MEAL: Photographer and assistant/second photographer (if applicable) shall be provided with seating and a meal at the reception. Please note that Photographer may take short breaks during the event to adjust equipment, utilize restroom and stay hydrated.

SOCIAL MEDIA: Client may share and post Photographer’s work on all forms of social media with the requirement of crediting the Photographer. Sufficient credit includes tagging the Photographer or Photographer’s business page/account, providing Photographer’s website link or simply citing the Photographer’s name or business name in post/s. Client may not crop, (with the exception of automatic cropping of Facebook profile pictures) apply filters or alter Photographer’s work in any way.
